by commissioning @itsbinches, the client agrees that they have read and accepted the terms of service in full

 brief terms of service 
✦ USD, PAYPAL, KO-FI, VGEN
✦ NFTs and AI learning uses are not allowed
✦ refunds & cancellations OK, chargebacks NO
✦ rush commission and NDA fees apply
✦ credit @itsbinches

 payment & fees 
✦ payment currency in USD (US Dollars)
✦ available payment options: PAYPAL, KO-FI, VGEN
✦ full payment must be made upfront prior to working
✦ rush commission fee of +$10 flat rate up to +200% depending on deadline
✦ please note, there are pricing differences between DM/email requests and VGEN requests. fees applicable in all cases

 refunds & cancellations 
✦ chargebacks and processor disputes are not allowed
✦ all refund and cancellation processes must initiated by @itsbinches
✦ all cancellations after payment will be subjected to a 20% fee ― in which the client will receive a maximum refund of 80% of their payment
✦ in the case that the commission request cannot be completed, the client will receive a full refund

 copyright & usage 
✦ @itsbinches will retain all rights to the work(s) and thus can include them in a portfolio for self promotion related uses
✦ all preparation materials (WIPs, bases, designs, etc.) used to create the commission will remain the property of @itsbinches and this is inclusive of the rights to repurpose the materials for any reason and in any future works

✦ by default, clients may use the commissioned work(s) for streaming & online promotional purposes across all streaming and SNS platforms (Bilibili, Twitch, Youtube, etc.)
✦ only the client is allowed to use the commissioned work
✦ clients are not allowed to claim the work as their own production, use them for NFTs, use them for AI learning, or mass resell/redistribute the work in any way
✦ the client is not allowed to edit, animate, or add onto the commissioned work(s) in order to resell at a higher rate for any reason ― recoloring or animating for self-use only is allowed
✦ reselling in a package due to streaming graduation, full rebranding, or other event is allowed with notice and only at the original price paid
✦ the client must credit @itsbinches in all possible cases

 privacy & nda 
✦ @itsbinches will mention the clients when sharing the completed work(s) and/or WIPs ― clients may request to not be mentioned
✦ delayed publishing of 100 days after delivery can be requested at no additional cost ― not inclusive of WIPs and @itsbinches may immediately post the work after the client has publicly used/posted the work regardless of the delay request

✦ NDA 1: the overall creation process (WIPs, live streams, etc) can be kept private for +50% of the total commission ― only the completed deliverables can be posted and shared publicly✦ NDA 2: the overall creation process and the completed work can be kept private for +200% of the total commission ― @itsbinches will not post or share any content relating to the request creation process WIPs or final deliverables, however the client must still credit @itsbinches when using the work(s)

 timeline and process 
✦ once the work has been completed and approved, the files will be emailed to the client directly
✦ all deliverables will be in the digital format and the client understands that there is no physical product to be shipped
✦ delivery date will vary between requests but most commissions are expected to be completed within 7-21 days after payment. any deadlines and rush must be communicated ahead of time

 revisions 
✦ unlimited revisions before finalizing the overall design (i.e. all WIPs that are in b&w, base coloring stages, and other small design elements)
✦ up to 3 minor revisions after finalizing the overall design
✦ major revisions may incur additional fees which will be discussed and communicated to the client
